EUCannaJobs Standard Terms and Conditions for Services

 

These terms and conditions ("Agreement") govern the use of job advertising services ("Services") provided by EUCannaJobs ("Company") to employers and other users ("Clients" or "You"). By using our Services, you agree to be bound by these terms and any additional terms specified in writing by the Company. Please read this Agreement carefully before using our Services.

 

Service Description:

 

a. Job Advertising Services:

 

Our Job Advertising Services focus on getting your job openings in front of the right audience through various platforms and channels, ensuring maximum exposure and attracting a pool of qualified candidates.

 

b. Headhunting Services:

 

In addition to traditional job advertising, our Headhunting Services go the extra mile to find the ideal candidates. Our experienced headhunters utilize their industry knowledge and extensive networks to identify and approach high-caliber professionals for your specific roles.

 

c. Other Advertising Services:

 

In addition to our services, we are pleased to offer a range of other valuable services designed to enhance your brand's exposure and increase your reach in the market. With our advertising for exposure solutions, we strategically position your brand and job openings across various high-traffic platforms and media channels to maximize visibility. Whether it's through targeted digital campaigns, social media promotions, or industry-specific partnerships, we ensure that your company's message reaches the right audience. 

 

The Company may also offer new services from time to time based on industry and client needs.

 

Account Creation:

 

Clients must create an account to use our Services. You are responsible for providing accurate and complete information during the account registration. Keep your account credentials confidential, and promptly notify the Company of any unauthorized access or use of your account.

 

Job Advertisements:

 

a. Clients are solely responsible for the content of job advertisements posted through our Services. The content must comply with all applicable laws and regulations, including those related to equal opportunity employment and non-discrimination.

 

b. Job listings should explicitly describe roles that involve tasks, responsibilities, or functions directly tied to the legal cannabis, CBD, or hemp industries. 

 

c. The Company reserves the right to refuse or remove any job advertisement that violates our policies, is misleading, offensive, or inappropriate, without prior notice. This includes job listings for unrelated industries, multi-level marketing schemes, illegal activities, or positions promoting substances legally banned.

 

Payments and Fees:

 

a. Payment of subscriptions and fees 

 

  1. Unless a different payment schedule is applicable, which may reflect a period payment period (e.g., weekly or monthly), all fees are due (and payable) from Client within fifteen (15) days.

 

  1. For recurring or subscription-based advertising services, payment is due at the beginning of each billing cycle.

 

  1. Payment of taxes
    1. All Fees owed by Client are exclusive of, and Client shall pay, all applicable taxes.
    2. EU VAT Taxation
      1. The Company is duly registered for Value Added Tax (VAT) purposes in accordance with the applicable EU VAT regulations. The Company's VAT registration number is EE102546831.
      2. The Client is responsible for providing accurate and up-to-date information regarding their VAT status and registration details. In the absence of such information, the Company reserves the right to apply the standard rate of VAT.
      3. Where applicable, exemptions and zero-rated supplies will be treated in accordance with the relevant provisions of EU VAT law.
    3. Please note that the sales tax rates and regulations are subject to change. As a result, the amount of sales tax charged on your invoices or receipts may vary over time based on updates to the tax laws.

 

  1. Accepted payment methods

 

  1. We currently accept payments via credit/debit cards and may offer other forms of payment in the future.

 

  1. Currency and exchange rates

 

  1. All payments are made in Euros (€). If the payment is made in a different currency, the exchange rate applied will be determined by the payment processor or the issuing bank.

 

  1. Cancellation terms

 

  1. Job advertising orders can be canceled before the advertising campaign begins. However, after the campaign has commenced, no refunds will be issued.

 

  1. Late Payments

 

  1. In the event of a late payment, a late fee may be applied, as specified in our fee schedule or agreement.

 

  1. The Company reserves the right to suspend or terminate advertising services for accounts with outstanding payments beyond a specified grace period.

 

Job Advertisement Duration:

 

The duration of each job advertisement shall be specified in the chosen advertising package. Upon expiration, Clients may choose to extend the ad for an additional fee or create a new advertisement.

 

Candidate Data and Privacy:

 

a. The Company may collect and process candidate data as part of the Services. Clients are responsible for complying with applicable data protection and privacy laws.

 

b. The Company will handle candidate data in accordance with its privacy policy, which is available on the Company's website.

 

Intellectual Property:

 

Clients retain ownership of their job advertisement content. However, by using our Services, Clients grant the Company a non-exclusive, worldwide, royalty-free license to use, reproduce, and display the content for the purpose of providing and promoting the Services.

 

Indemnification:

 

Clients agree to indemnify and hold the Company, its officers, employees, and affiliates harmless from any claims, damages, losses, or liabilities arising from the use of our Services or any violation of this Agreement.

 

Limitation of Liability:

 

The Company's liability to Clients is limited to the amount paid for the specific Services that caused the alleged damages. The Company shall not be liable for any indirect, incidental, consequential, or punitive damages.

 

Termination:

 

The Company may terminate this Agreement and suspend or terminate your account in case of any violation of these terms or for any other reason at its discretion.

 

Governing Law and Dispute Resolution:

 

This Agreement shall be governed by and construed in accordance with the laws of Germany. Any dispute arising out of or related to this Agreement shall be resolved through arbitration in accordance with the rules of German Arbitration Institute (Deutsche Institution für Schiedsgerichtsbarkeit) (DIS), with the seat of arbitration in Berlin, Germany. The language of arbitration shall be English.

 

Modifications:

 

The Company reserves the right to modify these terms and conditions at any time. Updated terms will be effective upon posting on the Company's website.

 

By using our Services, you acknowledge that you have read, understood, and agreed to these terms and conditions. If you do not agree with any part of this Agreement, you should not use our Services.
