According to information tracked by CosmeticOBS , France's intention to classify CBD as toxic at the European level is now an official proposal.

 

If the process goes through, CBD will be banned in cosmetic products in Europe, with implications that are difficult to gauge for other types of products.

What happened?

In June 2023, France announced its intention to ban the use of cannabidiol (CBD) in cosmetic products in Europe.

The idea was to classify CBD as CMR, i.e. Carcinogenic, mutagenic and toxic substance for reproduction, and therefore banned in cosmetic products in Europe.

As we explained then, CBD is indeed in the CosIng , the European database of all cosmetic ingredients approved in Europe, for anti-sebum, antioxidant, moisturizing and skin protective uses, but is not regulated by Cosmetic Regulation 1223/2009 on cosmetic substances and ingredients.

 

The European Commission launched a call for data in 2023 with the aim of preparing a mandate for the work of a Scientific Committee (SCCS). The latter should therefore soon have to rule on the safety of CBD, taking into account the possible unintentional presence, in trace amounts, of other cannabinoids , including THC.
